Landlord won't return last month's rent or deposit

In Ontario, "last month's rent" is not a damage deposit — it applies to your final month. Landlords cannot keep it for normal wear and tear.

Your rights (general)

  • Last month's rent prepayment must be applied to your last month — it is not a general damage deposit.
  • Landlords may only charge for actual damages beyond normal wear and tear, and must follow proper processes.
  • If money is owed after move-out, you may file a T1 application with the LTB to recover it.
  • Keep move-in and move-out photos — they matter if deductions are disputed.
