How to get your deposit back in Ontario

Move-out disputes are common in student housing. Know the process.

In Ontario, what many students call a "deposit" is usually last month's rent prepaid at move-in. Landlords cannot usually keep it for normal wear and tear. Disputes spike every April and August when co-op terms end in Waterloo.

What landlords can deduct

Landlords may claim costs for damage beyond ordinary wear and tear, or unpaid rent. They need evidence — photos, invoices, and a clear explanation. Cleaning fees for a unit left in reasonable condition are often challenged at the LTB.

Step 1: Ask in writing

Email your landlord with your forwarding address and a formal request for your last month's rent return. Keep copies. Our deposit recovery guide includes a demand letter PDF you can fill in.

Step 2: File with the LTB

If the landlord does not return money you believe you are owed, you can file a T1 application (tenant application for a rebate). Document move-in and move-out photos, your lease, and all correspondence.

Prevent disputes at move-in

Complete a move-in checklist with photos the day you get keys. Email the package to your landlord to create a dated record. That single step prevents most deposit fights four months later.
